Therefore, today, Donald J. Trump, or any other individual who has already served two terms as president, is constitutionally barred from being elected to a third term.
For Donald J. Trump to pursue a third term, the following steps would be necessary:
1.- Constitutional Amendment:
The 22nd Amendment would need to be repealed or amended. This would require a two-thirds majority vote in both the House of Representatives and the Senate, followed by ratification by three-fourths, 38 of the 50 state legislatures. This is a highly challenging and unlikely scenario given the significant bipartisan support for term limits.
2.- Legal Challenges:
Alternatively, there could be legal challenges to the interpretation of the 22nd Amendment, though such challenges would face substantial legal and political hurdles. Even if Congress and the states somehow agreed to repeal the 22nd Amendment, the Supreme Court or political opposition could still challenge the process.
3.- Public Support:
Even if a constitutional amendment were pursued, it would require widespread public support. The political climate and public opinion would need to be strongly in favor of allowing a third term for a president.
Bottom line:
Given these substantial barriers, it is currently not feasible for Donald J. Trump or any other former president to be elected to a third term under the existing constitutional framework. As of now, Trump cannot serve a third term legally unless the U.S. Constitution is amended, which is nearly impossible under current political conditions.
The only way for Donald J. Trump to remain in power beyond 2028, something that he is already considering, would be through indirect influence or an unprecedented constitutional crisis. Instead of a third term, Trump could try to maintain influence by endorsing a loyal successor and running as a power behind the scenes. A Constitutional Convention could be called if two-thirds of the states request it, but this has never happened in U.S. history.
